How can a citizen in the UK sue an over seas company?

Yesterday I received an iPhone 7 red 128gb which I purchased from https://smarter-phone.co/uk/

The item I purchased was listed as in "premium condition" which states that this item has no signs of use or wear, no scratches, dents, knocks etc… I went with Premium condition as this was a gift.

Upon opening the item I noticed scratches across the length of the screen, a small doesn't on the rear along with a faded circle patch. Refer to images.

I've left 4 messages and sent 2 emails and have not yet received a response.

Their returns policies are shocking as they only allow 14 days from the date of purchase to return the item, even though it takes over a week to be delivered!

I've now seen hundreds of negative reviews on this company, all stating that the items are always wrong, not to the quality as advertised, lack of customer support, etc…

I'd like to get some info on how to potentially sue them for my money back if all other methods of resolution fail.

Any help would be appreciated! How can a citizen in the UK sue an over seas company

Google 'distance selling regulations uk', this may help. The CAB may be able to advise you further.

Kid, you're buying second hand phones, let's face it, you don't have the money to sue anyone. Grow up, accept your loss, learn from it and move on.

Try disputing it with your credit card company. Some credit card companies can help you get what you want if the product isn't what it says it is.

Find out what country or state has jurisdiction - it should be in their conditions of contract.- and sue in their courts. If it isn't, sue in the UK.

If the vendor doesn't honor their sale (e.g. Refunding the cost of a mislabeled product), a quicker remedy would be to contact the bank that issued the credit card you used to make the purchase. I don't know too much about UK law, but the credit card companies tout that as one of the benefits to using a credit card.

My question is if I need insurance for my company to cover this, even though I did not break it, but it was a malfunction of the phone? My company is T-Mobile.

  • Cell phone plans for US citizen living abroad in Europe for 3 months? I will be living in Barcelona, Spain for 3 months in the summer and I want to bring my cell phone with me from the US and use it while I'm there. I have an iPhone 6 that's out of contract with Verizon which I will unlock before I move. I will be traveling within Europe occasionally, every other weekend, and I don't know what will be my best strategy for having a cell phone plan with adequate data (4+ GB) while I live in Spain as well as when I travel to other European countries.
