I broke my friend's phone
It happened last week. Basically me and my friend (we r both 13) were walking to the nearest train station from the cinemas. She was immersed in her phone and I told her to get off it because we were crossing a road. She didn't listen. A car was coming up at her who wasn't paying any attention so I ran and pulled her out of the way of the speeding car, and she dropped her phone when I was pulling her. During that time I had broken my ankle and patches of skin were ripped off. She screamed. Turned out she was screaming at her cracked phone rather than my hurt ankle. Anyway I'm in hospital whilst have stitched up my ankle. She visited me today and said I have to pay full for a brand new iPhone 6s (she had the iPhone 6). I told her that I didn't have to pay for a brand new one as hers was already old. No asking me if I was better, just demands. Her parents said they will sue my family if we refused to pay. I mean, a. I saved her damned life and b. She's demanding for a better phone without asking me if I'm better. What to do
Why?
You are not legally responsible for her phone. She was holding it; she dropped it. Your family should be demanding payment for your hospital bills from her family. If you're in the US, talk to your insurance company about this. If you're in the UK, I don't know what the rules are. Talk to a solicitor.
This is something that should be handled by your parents. You should stay out of it.
Nothing!
It's hard to believe this is not a bogus post but, if not, let her sue you. If a judge believes you were in the process of saving her life the judge is likely to find that the accident took place in her service for her benefit. In that case it is unlikely a judge who hold you liable for the damaged phone. Even if a judge does not believe you, the most you are liable for is the value of a used phone the age of the phone that was broke (probably not too much).
NO, you didn't- and you shouldn't go around saying that.
Do what Noehair and Hawarda said- let them sue you.
Go to court on crutches, with a report from your hospital visit in hand, and a witness statement or surveillance video from the near-death experience.
Oh, to be able to see the look on that judge's face. But it would cost them $200 to take you to court for small claims, so I doubt highly they will when they find that out. Just let them stew.
You should locate the lamb sauce.
Let them. They will lose and have to pay your attorney's fees! So tell them to stick it up the tail pipe! =P
She should be more concerned about your ankle & herself rather then her stupid phone
- My teacher stole my phone! And my friend's She said she wanted an iPhone 11 and a Huawai Mate so she just took them? She collected them before we watched the movie saying she wanted no interruptions but she just stole them.
- My friend stole and broke my phone? So basically we were watching a movie in my living room together and were both 14 and he was on his phone during the movie and i told him to get off and watch and he just ignored me so i tapped him and he HIT me and said "will you **** off?" and i told him stop being rude and he grabbed my iphone XR my phone and threw it across the room and i went over to get it and it was cracked and shattered so i screamed at him for breaking my phone for no reason and he just laughed and left
- My friend broke my phone and refuses to pay for it? What do i do? So we were hanging out and i had my iphone and i was texting my crush and he asked who she is and i said she is my friend and he grabbed the phone and said "(my name) has a crush on you" so i grabbed it back and said STOP and he laughed and grabbed it back and through it across the room and it cracked and i SCREAMED What the HECK and told him to STOP! And be stomped on it and smashed it more
- Is it ethically correct to charge my friend for breaking my phone? I have an iPhone 7Plus (not covered under apple care) and today my mate and I were messing around and he slapped it out of my hand, smashing it. I checked screen replacement prices and it was around $260AUD to get it fixed from the apple store. We're good mates, but he has been dodging me since the event took place.
