I found an iphone 5, can I get charged?

Hi, I found an iphone 5 after school on the stairs the other day, it was locked to bell and I'm with rogers, so I decide that I would post an add to trade it with anyone with an iphone 5 with rogers. Well anyways I got caught from the police and they think I stole this phone from the person it belongs to, but I found it and I had no way of knowing who it belonged to, and yes I no I should of just returned it to the office, and I really wished I did but I didn't because my phone is smashedd so I thought it was my lucky day, finders keepers. Anyways I'm just wondering can I be charged for this? I didn't take it from the person, I don't even no who they are still, I'm 17 and I found it after school

You knew it was not yours, but you still took possession of it and tried to trade with someone so you could have one to use.

That is theft, and you probably will, and should, get charged.

*EDIT* - If you didn't try to find someone to trade with, you MIGHT have been able to say you were holding it to look for the proper owner. It's a stretch, but you might have gotten off doing so, with them just taking the phone to return to the proper owner.

You've done what is known as receiving stolen goods. What you're claiming happened is what every thief claims when he is caught.
