No however you can update it over the air as soon as you get it or plug it in to your pc/mac and update with itunes

If you buy it new, it will have another iOS but you can always upgrade to the 6. And let me tell you, I have an iPhone 4 and iOS 6.1.3 and it works just fine.

Seeing that the update was issued just a few days ago, I doubt the iPhone 4S's in stores are already that recent (they probably have been sitting in the store for a while now).

I guess you're asking this because of the jailbreak so yes, your iPhone will be jailbreak compatible.

Not necessarily…

- If you buy one from an actual apple store it's gonna be updated to the newest iOS

- If you buy from mobile phone company there's a chance that they may have had it for awhile so it won't be on the newest iOS. Just ask if they have ones that have been sitting around for awhile.

Yes. Apple is usually on top of making sure any new models sold have the latest version of iOS.
