Is it legal for a school to take your phone overnight and then to their home?
The other day, my school took my phone after it went off in class. I took it to the office, and my school said my parent could pick it up after school or that it would be held overnight. My mom wouldn't have time to get it before school closed, so overnight was the only option. Fair enough, I already learned that it is legal for them to take my phone overnight. My concern is that once I was home, I looked on my moms Find My IPhone and I see that my phone isn't at school? I put the address into Google Earth and see that it's someone's house? That doesn't feel right…
Is this even legal?
That is absolutely not ok, one of your parents should do some looking into this. But… Try to remember to follow school policies about cell phone use, mmmkay?
The school has what are called "Custodial Rights" meaning that when you are at school, you are under their care as if they were your parents or they are acting in place of your parents. Would it be legal for your parents to take away your phone? Yes. As a minor, you don't have too many rights. You have the right to not be abused. But taking away your phone is not abuse. People got along quite well without cell phones for thousands of years. They can't lock you in a closet but they can take away your cell phone. As far as not leaving it at school, they may have brought it home with them to keep it safe. You have the right to have your parents transfer you to another school if you feel your feelings have been hurt. No one has broken the law here in my view.
No it isn't legal. Report the teacher to the principal or an adult. Escpecially if it is only because it buzzed. However if you were playing on it, it's your own fault.
"their home"? Schools don't have homes. If a teacher or other staff member took the phone home overnight it was for safe keeping.
It's totally legal.
Which would you prefer:
The phone being left at school for anyone to take
The phone being put in a purse/briefcase and left there in someone's presence most of the time?
See, what you don't get is this. If the phone had been left at school and got stolen, the school isn't responsible and you wouldn't get a new phone if it was stolen.
A teacher taking it home is more of a gray area and likely would have to replace it if stolen.
You're also forgetting this. If someone wants to get into your phone - they can do it at school too.
YES!
Once the school has taken your parent's property they have created a "bailment" situation where they have become responsible for the property in question. This means if the school official in charge of your phone feels it will be safer in their direct possession instead of locked in a drawer at school overnight then they will keep the phone with them. Most school insurance policies aren't going to cover stolen valuables left on school premises especially after school hours.

Look if your parent doesn't want the school to take their phone in the future they need to make sure you understand and STRICTLY follow the school's policy on cell phones. Due to another legal responsibility known as "In loco parentis" teachers and other school officials have many of the same powers your parents have to regulate your time at school and punish you if you don't comply.
Yes, it is legal. In fact, the teacher is being responsible. If left in a classroom, it would be at risk and in her office - people are in and out throughout the day and sometime, when she is not there. She is keeping it safe - making sure that you will get it back.
Thank you for your answers! I reported it to my school in either case.
