Is it possible for me to buy an iphone 4s from ebay to swap out my 4 with?

My phone won't charge anymore. At all. Its been time for a new one, but i don't want to pay over 100 dollars for repairs when i can get a new phone for that same price. And plus the back is broken and falling apart. Will they give me trouble since its not the exact same model?
