It's not actually uncommon for this to be the case. However you have to understand that until the contract is paid off, the phone is not your property. As such selling it could open you up to charges of theft and/or fraud. Also this would not stop the owner (the mobile company) from later blocking the phone by IMEI!

He still has to pay $300 to T-Mobile and I was wondering, if I were to buy the phone, would T-Mobile make me finish paying it off? He said he's going to finish paying it off but if he doesn't & I end up buying the phone, will they tell me anything since he didn't finish paying it & it is now mine? Will I have to finish paying it off if he doesn't?
