Jailbreaking is legal. Apple tried to make it illegal about 6 years ago, but they failed.

Now, when you jailbreak the device, any warranty you have is void, so if the phone breaks, Apple won't fix it since it is jailbroken. A quick way to bypass this is to restore the device in iTunes; this will erase everything off of the device.

How you do it depends on the iOS version that your phone has. Go to Settings>General>About>Version
There currently is no jailbreak, at least a public one, for 9.2-9.3.1, so if you have any of these versions, you can't jailbreak yet.
