My child gets supervised visits every saturday by her fathers sister whom is by court order a non-professional visitation supervisor. Last weekend my daugther who refuses to speak with her father was ordered by his sister (the monitor of the visits) to sit next to her while her father tried talking to her. My daughter noticed that tuck in the monitos sleeve was her iphone and it was on the "voice memo" app recording. My daughter still refused to speak during this time and was told by her father withthe monitor present that they will be doing this with her eveytime she comes to visit. I tried looking up if this was legal for her to do and to allow him to say what he said but couldnt find a thing. My daughter called her lawyer the following monday and all she said was to follow the monitors house rule. Now I know that is not a house rule. In the court order it only says for to supervise nothing mor nothing less. I also emailed my lawer and still haven't gotten a response. What do I do?

i understand if she wants to take notes but don't force a child into something. My daughter is due to go back this weekend and said she is going to deny being recorded. She should have that choice to engage or not to engage.

It's a parent and child relationship. It's no different then you. Your the parent. Do you have a right to sit your child down and talk to her? And as a side note, if you take this to court the judge is going to point out that your allowing the child to not engage with her father.

OK, the thing with recording is a bit weird, and I don't understand why he's doing it. It does seem wrong, but there aren't really laws against this. All he's doing is recording his own daughter. She's his child, so he doesn't need her consent.

Your best bet is to talk to the father about this. Or talk to his sister. You can go to court. Judges don't like it when you come to court over parenting issues, but the judge will probably rule in your favor (unless the father has a good reason). And your lawyer will be happy to bill you a few thousand dollars.

If he's planning on using these recording in court, or use them against you, that will backfire on him. The judge will see that as him trying to use the child against you.

There are very clear rules about voice recording in every state in the US.
Federal law permits recording where at least one of the parties to the conversation consent to being recorded.
Therefore, it is unfortunately legal.

Your daughter can speak to her lawyer and complain to the court about being made to sit next to him- I know kids who have objected to visiting with their parents, in which case the other parent was required to make them available for visitation, but the kids finally objected enough to be able to end the visits. She does NOT have to speak or in any other way communicate with him if she doesn't want. That is her right to freedom of speech- or lack thereof it. Even if she is a minor, she has that right.

Legally, children can't give consent. Their parents must give consent on behalf of the child. So the short answer to your question is - listen to your child's lawyer.

Wait for your lawyer's response. It sounds like your baby daddy is trying to get your daughter to say something incriminating about you. Probably so he can argue you're unfit and gain full custody.

So court appointed and you have already asked your legal advisor… The father is a parent in exactly the same way as you are and has every right to 'try to talk to his child' exactly the same as you do… Start by realising this is not about you or him, it is about a childs right to have both parents in their life regardless of why you think it is only you who has any 'rights' to talk to /see the child, so take your own feelings out of the equation, take your dislike ( now) of him and her aunt and think about your childs rights to know him and his family
