Scammed on craigslist. Is there anything I can do?
This all happened on July 5th. I called the guy, and everything went good. Shortly after, I received a text from him with the address of the location we would meet up at (Walgreens).So we met up at the parking lot, I inspected the iPhone 5, and then he went ahead and showed me that the IMEI was correct through my phone (didn't say it was blacklisted or anything though, just the specs of the phone). I said everything looked good, we walked into the Walgreens, then I pulled out $420 from the Chase ATM. I gave him the money right outside of the front doors. Finally, popped in the sim card for two hours, but nothing happened. I called T-Mobile to check the IMEI for me, and they said that the phone was reported lost or stolen. In addition, I asked them when it was reported, and they told me on July 3rd (or July 2nd, can't remember specifically).
So is there anything I can do to get my money back? I have his first and last name (I know it's real, checked his Facebook), call/text logs, his car's model and car, his two phone numbers he used (called with one and texted me with another). I know that the phone was not working when he sold me it because I got the date it was blacklisted on. He deleted the craigslist ad, but I did find another one VERY similar to the one he posted (same price, another black iPhone 5, same address, and also did not come with any accessories like the one he sold me).
Added (1). I don't think his Facebook profile is fake. He has a lot of friends on there, I can see some of his posts, and also he has ton of pictures of himself. So I believe his name is correct, and also I checked his phone number and the voicemail recording he left, he said his name.
Added (2). I've also found out where he lives, and I can confirm the address is correct.
I don't know but if I were you I'd go to the cops and tell them.
I would call him back and tell him its reported lost or stolen and you want to do an exchange to get your $ back. Tell him you would rather do that other you will file a police report since you have his phone number.
Think about it next time, who sells an iphone 5, the latest version? No one unless its stolen or damaged.
Don't know why people buy valuable stuff on Craigslist. There's no protection.eBay is a far better medium.offering proper protection to buyer and seller alike.
You will find that the facebook id is a fake. You will find that the phone numbers don't tie up to your man. You will find that his car isn't his car or is registered to a false address. It is not as though he hadn't known it was stolen - since he knew he was selling knock-off goods, he would have made sure that his id was safe.
So no, I don't expect you will get your money back. Sorry.
DON'T use Craigslist for stuff like this. Use eBay, Amazon, etc. And yes, sometimes it costs more - guess why.
If you're going to buy a phone from someone, you should meet them at the carrier's store so they can check the ESN/IMEI before you pay for it. If the seller isn't willing to do that, it's a giant red flag.
