Someone at school destroyed my iPhone on Friday, what should I do?

I have an iPhone 4S which I saved up for a year to buy with Birthday money, Christmas money and money I earned myself. I got it as it went down to £349 and I bought my first ever smartphone. On the way home from school on Friday somebody thought I was taking a picture of them but I wasn't I was texting and they threw the phone on to the dirty concrete floor and stamped on it and punched me in the face. The phone does not turn on or work in any way any more, the screen has cracks everywhere, the home button popped out and the back glass came off. The person has anger problems and afterwards apoligised but that is not good enough as my phone is still destroyed. They refuse to pay for a new one and my parents won't buy me a new one either. What should I do?

You can charge them legally. They destroyed private property.

Hopefully you bought insurance on the phone. They can definitely get you a new one for less than what you originally paid.

Why should your parents buy you a new one? They didn't smash it. You have no right to hold them responsible. Report the assault and the damage to the police. They should charge the person criminally. Follow up with them. After the criminal proceedings are over, you can then sue the person in civil court.

Next time, be careful with expensive items in public. Don't allow anyone near them. It could have been grabbed and stolen by someone running by. You will just have to do without it until you can either afford another one or until you have sued and recovered enough money to replace it. Until then, get a cheap phone or cancel the service.

Report them to the police for assault and criminal damage. Not much you can do about the phone, unless you had insurance on it.

Why did you pay that much for a new one of those when after Christmas the second hand market was flooded with them for a lot less than that?
