USPS lost my package from eBay and the seller refunded me, should I still file a missing package claim?
I had ordered the iPhone 7 for my birthday last week and I never received my package. I went through a whole ordeal with USPS (who was no help at all). Eventually the eBay seller was happy to issue me a full refund but I'm wondering if it's worth my time to file a missing package claim.
If the seller gave you a refund, it's because the seller insured the package, filed a claim with the USPS when you said it went missing, and got paid after the USPS tracked the package and determined it was not delivered to you nor could they locate it.
You are whole. There's no reason to file a missing package claim. When filing such a claim, you will be asked if you've been reimbursed for the contents of the package. You could lie and try to double dip the system, but the USPS will know they paid a claim on that package to the seller and will investigate, at which point the USPS OIG will discover you've committed fraud, which since it's the USPS, is a felony.
The seller will file the claim. Since they refunded you, you don't have a claim.
What's the point - you got a refund. If it eventually shows up, be sure and return it. The seller will no doubt check up and if it shows delivered to you, she could have you charged with fraud. And, of course, have the refund reversed.

- How long should it be until my package gets here? (USPS)? Its an iPhone 4 so not very heavy or large and its coming from Rigby, Idaho shipping to Daytona Beach, Florida threw USPS it was shipped out on the 22nd and its the 25th. Plus I know Sunday won't count, anybody have any clue? I'm just super anxious about getting my new phone.
