Can I get into any legal trouble for selling a non working item on Craigslist?
I know what I did was wrong but I posted an ad selling the iphone 5 on Craigslist for 350 bucks… Only this issue is that the iphone was not working at all. It did not turn on or power up as I think it was water damaged. Anyways, I had everything in the box like normal and went to meet up with the buyer. She looked at the phone and I told her the phone was dead but since the overall condition was good, she believed me. She gave me the 350 and we went our separate ways. The phone I was communicating to her with was a track phone and I have since turned it off since I know she has probably bombarded my phone with text and calls when she figured out it wasn't working.
I know it was wrong to scam her and I'm really apologetic about it but I really needed the cash. She doesn't know where I live since we met in a public place. Only thing she knows is that it is 10 minutes from my home which could be anywhere. But if she did contact police and somehow found me, could I be arrested or get in any legal trouble for this? If so what is the worst that can happen?
Fraud.
This is the same as Highway Robbery, and you should be prosecuted to the fullest extent of the law.

If you were the original purchaser of the iphone it can and will be traced back to you. I hope she tracks you down. That's the same as stealing and you deserve to be caught. Oh, she can also file a small claims case against you.
This Felony Fraud. You knowingly set out to defraud this person. She will have
hopefully by now contacted the local Police department. Filed a complaint.
And now they will become her eyes and ears.
So you needed the cash and stole from her? Why did you think it was okay to do this.
You will be prosecuted for this.
With water damage it is easy to check, since all batteries change colors, so, even if she were to go to a iphone store, they could verify if the reason the phone does not work, is due to water damage.
Now, with this iphone, guessing she could try and get this phone registered to operate it? At that time, (maybe), they could find out the prior owner (you) that had it before she bought it.
Have never dealt with Craigslist, but they may ban you from selling anything else in the future due to your scam of selling a phone that does not work.
If it was me, would go to the police and report your scam, not sure if they would pursue or not, but if you are ignoring her, my guess, she will do whatever it takes to get her money back. She will probably have the copy of your post of selling it, stating that it was working and not dead.
But, I do question that when you told her it was dead, that she did not ask to have it charged to verify it was working, before handing over the $350?
Does she have your name, if so, might be able to do a google search of you to find out where you live. Are you on facebook, can find info there.
IF, she is able to find you and if you do not refund her money, then, she can file a complaint in small claims court and sue you.
