Try a hard reboot first - hold both home and power for around 10 seconds, until the Apple logo appears.
It does not delete anything, just forces a proper "clean boot".
If that does not work, a reflash may fix it; they occasionally get problems due to a corrupted update, like any computer.
Back it up via itunes first, if there's anything you want to keep.
Then press both home & power buttons, but release the power button after 8 seconds and continue to hold the power button (for about another 20 seconds)
Hold until you see a "Connect to itunes" graphic or itunes detects the phone as being in DFU mode.
itunes should detect it as needing the operating system reloading. It will download the correct operating system and reinstall the whole phone, putting it back to "as new" state with the latest OS, all in one go.

When its finished, you can activate it as a new phone or put your backup on it during activation to make it as it was before, with your apps and data etc.
If it still acts up, it may have hardware faults or be water damaged etc.
So you've just come into possession of an iPhone that doesn't work, and you can't return it to where it came from? Maybe you should try buying one next time!
For the record rebooting is just another term for restarting.
You could try restoring it through iTunes or at least contact Apple about it.
