Not unless you take the phone to the police, and report it as found. Get a copy of the police report. Typically after a certain period of time and no one has claimed the i-phone, it will be returned to you. (Note: not all jurisdictions follow this policy). Get a copy of the release receipt from the police, and then you can take it to an Apple store to have them unlock it for you.
If it has iOS 7 no, you need their passcode.
Not without the original owners password to get past the lock screen. And it can't be used as a phone if it was reported as stolen as the IMEI is now blacklisted.
