Accidentally pressed charges?
I'm a mother who accidentally pressed charges on my son for a stolen phone. I lent my son my phone and was driving him to the doctor. He left the car and began walking unexpectedly. I tried to find him and found him in the town we live in, 3 miles from the town he left the car in. He said he just wanted to walk him, and I was afraid he would get hit by a car becase I admit I over worry. I knew he was walking home, but a woman called the police when she saw me drive up to him on his way home. The police arrived shortly after. They refused to pick him up and take him home or to me and said they only way they would find him is if she pressed charges for the Iphone I lent him as larceny. I agreed out of fear. They arrested him for felony larceny, despite me having lent it to him with an agreed contract of return.
They arrested him and put him in a holding cell. Then they had me and him go to trial the next day for his arraighment, But he never stole the phone, it was lent and I had overreacted. I desperately want to drop the charges and end the trial because we have family issues the we personally need to tend to. I was told I could recant these charges, but don't know how. Please help me end this trial and recant my charges. I do not want to press charges or see him go to trial for a misunderstanding as I lent him the phone and he never stole it. Please advise me how to save my family.
Go to the prosecutor and tell them you are not pressing charges. Go to your sons attorney and tell him you are not pressing charges and will not testify, he/she can handle it from there. Sounds like a big mess and maybe more to this story, but generally when the accuser refuses to press charges the case has to be dropped.
You can't "recant" charges. The only person who can press charges or dismiss them is the DA.
If you receive a subpoena, you have to testify and can't refuse. I assume he pled not guilty? Get in contact with his attorney.
