Then yes. Minors don't own property. Even the money you used was not legally "yours". So the phone is not "yours". Its HIS.
If you're under 18 - yes; you legally own nothing (anything you 'get' legally belongs to your parents).

That would depend upon your age. If you are not of legal age he can do whatever he wishes with it. You are not considered to be mature enough to make your own decisions.
