How to return an item on Ebay that said it wasn't returnable?

I bought an "iPhone 5" on Ebay with my mom's account, but the owner emailed her saying it was actually an iPhone 4. I just purchased it yesterday, but in the description it said that the owner doesn't accept returns. Since I haven't received it and it isn't as the title says, can I return it and get my mom's money back?

I've just contacted the seller and asked, but I'm so scared I can't return it! My mom has the Ebay money back guarantee…

The no-return policy does not apply to scams. You can open a dispute through ebay if you got deceived into buying another model. Obviously, give the seller the benefit of the doubt, and contact them first. But this is not a return, this is a claim.

Did your mother get the E-Mail about the item being misrepresented before it was sent? What was her reply? You should quickly get back to them that you're not interested in a four and cancel the order.

Just contact the sellers, if the sellers says that it can't be returned even when it was their mistake then contact Ebay and tell them what happen. Take screenshot of then item website, like the tittle that clearly said iPhone 5, and your emails exchanges with the sellers proving that it was the sellers mistake of not putting the right information.

Well first, contact the seller and tell him about him and confront him and them contact ebay tell them it was a scam and they will understand and handle the situation.

You have to be 18 to buy and sell on Ebay. I don't understand why parents allow their children to use their credit to buy items. You have to go to Ebay, on the Customer Support tab and request to cancel the transaction. If seller does not agree, you must proceed with the sale. Then you can sell the phone yourself when you receive it. Did the listing say it was iPhone5? If seller made a mistake, you have a case to cancel transaction. You can't return it if he hasn't shipped it yet. If a seller says he does not accept returns, that is true only if there's nothing wrong with it but if he misled you about the phone in the listing, he must take it back.
