I got scammed and i tracked down his address?

I brought a iphone 3gs pristine condition on craiglist. The guy said that everything works and i fiddled around with it.everything seemed fine. When i came back home and went on youtube i realized that the sound wasn't working then i plugged in a headphone it was good. That means this guy sold me a iphone with messed up external speakers.

i have the guy's number but he refuses to pick up the phone. I used reverse phone lookup to get his address i'm going to his home for my money back and if this does not workout can i file a report on him?

He did nothing illegal. You should have tested it more before you bought it. It is your problem now.

By the way, phones sold online are very often stolen phones. I would never by a phone online like that.

When you buy something used from a stranger, especially after you have "fiddled around with it.everything seemed fine" you take a risk. You were wrong about it being fine and that is your problem.

What you are planning is referred to in my neighborhood as "poking a snake with as stick".
I wouldn't - I also wouldn't ever buy a phone from anyone on Craig's List.
It could be stolen, and if you go back to them, you may find out what else they're capable of.
I assure you, there won't be a Returns desk.

File a report with whom? Craigslist certainly doesn't care. Nor do the police. You bought a used item, you inspected it, you accepted it. Case closed, he has done nothing wrong.

Go to the police with the phone and tell them this story, then ask them to run a check on the device's serial number and IMEI number and SIM card number.

If the phone has been reported stolen, you will have to turn it in to them as evidence.

You do not want to face a possible criminal.

It's also possible the phone has been so recently stolen it hasn't gotten into any law enforcement databases.

The first lesson is that Craigslist is NOT ebay! I would never, ever, buy anything from there, as there's no protection and no supervision of the marketplace.

Have you heard the phrase "caveat emptor"? It is latin, it's used a lot in such cases at law, and it means "Let the buyer beware".In other words if you buy a jeep, count the wheels.

What this means in your case is that he sold it to you "as is" and gave you ample opportunity to see whether it fitted your needs. End of story. Go to the police and they will not want to know. Sue, and you will lose. Go and ask for your money back and… Well he might be a super nice guy and give you your money back, but that is what it will take. He is under NO obligation to do so.

This one is entirely down to you, mate. Sorry.

Too late, as u checked the phone before you bought it. Like buying a used car "as is where is", you take it out of the lot, and it is yours. He didn't give you any written warranty.

The police don't care and consider this as civil matter, that you can take him to a small claim court. But, it just waste time and money and you likely won't win.

You can't report anything
All person to person sales are on an as is basis
It was your responsibility to make sure everything was working before you paid for it. If you didn't check the speakers, that was your mistake
The police won't do anything as there's no crime
