Sold auto parts on Craigslist now he wants to sue?
Here's the situation…
I sold a pair of used tires ($230/pair Sports Tires that goes for $500 each), the guy met me at a public area. He checked the tires condition. He found a chip on the sidewall of the tire. (I honestly did not know) He said he still wants to buy it but offered a lower price, despite the damage. So he offered ($100) lower than what I was thinking. I told him, I don't have to sell you the tires I'm going home with them. He said, "no, I want the tires" so he offered again ($130). I took the offer… Sold the tires with him aware of the damage.
We didn't sign any paper agreement only verbal.
He is 1 hour away…
Next week he texted me saying he wants to return one tire because he felt that I betrayed him and basically saying I was dishonest with my item.
I told him he made that decision when he bought the tires… He knew the damage and still proceed with the purchase. It's no longer my responsibility.
His idea: He wants me to send him a money order of at least half of the tires cost. ($60) So that leaves me with half the money less and he won't return the tire because he drives a Corvette and will waste gas to go here and give the tire back.
Or else he will sue me for big money. Garnish my income, blah blah… Claiming he knows a lawyer and all the big talk.
He doesn't have my name or address… Just a phone number from an iPhone App Free… Not my cell phone.
How do I respond to this?
Can he sue me for that in the small claim?
Sounds like he is all talk, so I would say they would laugh him out of court. But people can get a lot of information from a phone number.
Ignore all contact from him.
If he persists in bugging you, send him one message email that said you could not have been more clear that all sales are final. Remind him that he was given an opportunity to inspect the product at the time of purchase and he did so and still agreed to buy it.
Then never contact him again ever. And don't worry about his so-called lawyer that will never happen.
Just ignore him. There's no way he is going to go through the trouble for something so stupid. He could sue you but he would be spending more money to do so.
Well, just get this straight. You can sue pretty much anyone for just about anything in this great country of ours. Now, will he win? Me, I'd tell him to pound sand. If he wants to waste that much time and energy, not to mention money to sue you over $60 +/- well, that tells you what sort of person he is.
But next time you sell something to someone just make a receipt that says something like
"Item is sold as is and no warranty on it's condition is made and no refunds will be offered" make 2 copies, one for you one for the buyer, sign both, have them sign both.
But yeah, wouldn't worry too much about it.
Hell, last year we had some old Filipino bat threaten to sue us because the rice cooker she bought from our garage sale was "broken". Well, it wasn't broken when she bought it, she broke it and wanted her money back. Just part of the risk of the free market I guess.
There's nothing he can do. He had the chance to see the tires ahead of time and he chose to go through with the sale anyway.
Ignore him.
I would say he is just bluffing so he can get some cash.
It would be a huge waste of time and money to make a case out of the situation.
if their is no solid proof against you then it's just your word against his.
There are some pretty savvy douche bags out there that will prey on people who leave themselves open to liability claims. Not saying this is a person who does that but watch out bc just your # can give the person info on you. I wouldnt be too worried if you are an independent (not dependent) and don't have any assets anyone can go after. But if you do it can be searched and found out with the right resources. If you are dependent then they can go after your parents' assets. I know for a fact there are people who do this for a living just not on that small a scale.

I had my water at my house get turned off and I had been behind on my bills for 2 back to back months, so the phone was already out of service, but i had signed a two year contract, 4 months ago. It's free to me and he said he would gift me $20 on paypal if I do it. Is this legit or is this guy trying to pull something on me? It has a clean imei so it wouldn't be an issue, I just don't know if this is something that is going to get me into trouble
- Seller on Craigslist wants to ship product? I found an iphone wanted to buy off of the seller which was a local listing. After I contacted the seller he said he had moved to another state and would have to ship the phone to me. He wants to go through PayPal but I'm not sure if I should forget about it or if its safe.
- Is iPhone 5 sold in the US better than those sold in China in quality? I know that most of apples products are manufactured in China. But is there like any slight difference?
