What should I do with this eBay seller?
I just bought a brand new iPhone 5 32gb for Sprint on eBay for $350 which was a great price. I won the bid. Then I got a refund and a message saying that he was updating it to iOS 7 and "something" happened so he took it to Sprint to get it figured out so thats the reason he refunded me the money. I told him to tell me when it is done so I could buy it. But he said "When I repost it will email you first." I have a feeling that he refunded me money because he didn't get all he wanted to he will repost it for more. What rights do I have other then giving him a bad review. (It still shows that I won the item and need to pay for it.) Thank you.
My gut says you are right--that he doesn't want to honor the price.
However, you can't force him to sell to you. What you can do is neg him and file a complaint with eBay. If they think he's trying to avoid selling, they can drop kick him from eBay.
If he does list it for more money, than you can report him to Ebay. You should ask him to honor the price that you won it for.
That sounds like a bad faith seller to me. He could have withdrawn his auction at any time before it ended, but didn't because he didn't get the amount that he had in mind.

Timing:
A buyer can open a case after the estimated delivery date, or 7 days after making payment if you didn't provide an estimated delivery date.
A buyer has up to 45 days after the making payment to open a case.

This happens frequently but you have no reason to give him a negative review since he didn't do anything wrong. Sometimes items get damaged or broken. If he cancelled transaction for that reason, just let it go. If he wants to sell it he will list it again. Don't give any feedback since you did not get the item.
- USPS lost my package from eBay and the seller refunded me, should I still file a missing package claim? I had ordered the iPhone 7 for my birthday last week and I never received my package. I went through a whole ordeal with USPS (who was no help at all). Eventually the eBay seller was happy to issue me a full refund but I'm wondering if it's worth my time to file a missing package claim.

- I didn't get my refund from the ebay seller? I accidentally purchased an iPhone 4s from ebay. Soon after realizing what I had done, I quickly requested a cancelation before it was even shipped. He granted it. I asked him if I will receive my money back and he says that the amount should auto-refund as soon as I accepted the cancelation. He said it would take 24 hrs for the money to be refunded into my account. It's been three days and I haven't received the refund. I've tried emailing him but no replies. What can I do now?
