Will apple replace a blacklisted iPhone?
I know what you're thinking, so before you jump to conclusions, read on.
I bought an iPhone 5 from a car boot sale about a week ago and it seems the cheap turd that sold it to me went and claimed it through insurance as stolen, meaning the handset I bought is now blacklisted. I don't want to sell it abroad, because I was lookign for one for some time and this was a decent deal. My question is, if the iPhone is still under warranty, will Apple replace it when I go for a genius bar appointment, or will they confiscate it?
I've been getting very mixed replies on other forums and thought it best to turn to the mass public on Yahoo answers. Let me repeat the main question:
Will apple replace my blacklisted iPhone 5, will they simply hand it back and let me leave or will they confiscate it?
They will not replace it, its 50/50 if they give it back

I'm not sure if you tell the apple company that the guy sold it to you for whatever much you paid and tell them that he went and told someone saying it got stolen and ask should you do. Better tell the truth than to lie.
Forget warranty as that is irrelevant.
Did you buy the phone new from a recognised apple dealer.No.
Is the phone in anyway registered in your name.No.
The phone was reported stolen and insurance payed out on it, therefore phone now belongs to apple.
Can you expect apple to give you a replacement working phone.No.
Your problem at the moment is more to do with explaining how you came to be in possession of the phone.
It's highly unlikely. If a handset comes into store having been blacklisted its been reported lost or stolen by its original owner and its up to them to request the handset be un-blacklisted. It serves as a tool for retailers to reduce fraud, theft and proft of criminals and other people who (as in this case) fraudulently claim on an insurance policy.
You're best to learn that if it seems too good to be true, it probably is. An iPhone 5, highly desirable being affordable and cheap at a car boot? Unlikely to not have something wrong with it.
Nope. They would think its a stolen phone. Go back to that boot sale next time it's on. Find him and get your money back.
He might just turn up to try his luck with someone else. You never know
