Will Apple replace a legally jailbroken iPhone?

I know that jailbreaking an iPhone will void your warranty. But I also know jailbreaking is not illegal as long as you don't get paid stuff for free. I plan on just using jailbreak just for tweaks alone, which is not illegal as far as I know. So under these circumstances, which everything is done LEGALLY as the DMCA states, will Apple replace my iPhone 5s which is still under the warrantly if it breaks?

My phone currently has a camera problem as well so if I want to get that fixed should I just get it fixed then jailbreak, just jailbreak and fix it when I actually need to, or wait till warranty is over then jailbreak. My warranty ends in 4 more months and I don't think I can wait that long.

Added (1). If I jailbreak it now and unjailbreak it later to get my phone fixed, will Apple be able to detect that it's been jailbroken and unjailbroken before? Also how do you back up everything including apps' data and all you progress in games like angry birds since neither iTunes nor iClouds backup saves those kinds of data.
