Opening a case with paypal and ebay?

Ok, so basically on the 21/04/14 I bought an iphone 5s off a seller (on ebay) as we negotiated a price we came to an agreement to. The item was on bid and since it was on bid we decided to do the transaction on paypal. Now before I carry on, I hold full responsibility for carrying a transaction outside of ebay and I accept the issue is no longer in their hands. It's just that when I was offered such a good deal that fitted my budget i was willing to seize the oppurtunity.

When the seller and I were negotiating a price she responded very promptly and on time, and after I made the transaction she never responded once. Its been several days since I ordered the item and I'm certain I have been scammed because today and a couple days ago, 2 sellers have left negative feedback stating the seller is a thief and have also stopped replying to them. (At the time I ordered there was only positive feedback)

Whilst negotiating a price she said she will provide me with the tracking number and till this day I have received nothing.

Will paypal ensure she refunds my money. She hasn't responded to me since I have made the transaction

You can try Paypal but Ebay will not help if you did an offsite transaction. Also Paypal does not have to refund you if you acted outside of Ebay. You can try to file a dispute but they may not refund you if you did not pay through Ebay -- you never know. A friend of mine got scammed just like this and not only did Paypal refuse to help, but they also closed his Ebay and Paypal accounts for breaching the Terms of Use for doing an offsite transaction

Yes, paypal has a buyer protection policy. As long as u describe the case clearly to them, they will open a case with the seller and attempt to get it resolved within a stipulated time. If there's no attempt(response) made by the seller to dispute your claim, paypal will arrange a refund of the full sum u charged to your account.

He wanted to buy an iphone for a little less and offered the seller less to go through paypal to go around ebay and save on fees. The seller said if he would just send an invoice through paypal. I told him he could probably get screwed doing it like that but figured i would ask. So if he pays the invoice would he have any protection if the seller decided to be mean and not send it out?
