A housemate of mines accidentally broke my unlocked 16GB iphone 5 from AT&T customized with a purple screen, it was fully functional before the phone was broken. The phone was damaged from the girl bumping into my phone and my phone fell and a laptop fell on top of it. The girl agreed to pay for damages but at the moment I could not afford to get my phone fixed.
Long story short from me not getting my phone fixed pieces of the phone started to fall apart, screen damage, water damage, and the lock button was damaged. Basically a domino effect. I asked the girl another time "hey, are you planning on paying for my phone to get fixed" she said she has no intentions of paying for it to get fixed because times are hard for her, but times are hard for me as well. And the girl has a job, a nice flat screen tv in her room. It's been almost 2 months since I've been without a functional phone. And now I need to buy a new one. Can I take her to small claims court? Can anyone help me with this i'm 20 college student in NJ and i've never been to court. Can I ask for $650 the cost of another 16GB Iphone 5 from AT&T? Lawyers are preffered for answering. Where would I go to get an estimate? Etc. Please be very detailed. I also live with other housemates who are witnesses.
