I hung out with a friends yesterday one i didn't know and she didn't know and now it's believed he stole my airpods along with other stuff and i was too drunk to even know what was happened around me. Can he or someone he may sell it to use my pods even tho it's stil considered one of my devices. Everything got reset on find my iphone so it isn't there i just want them back

Yesterday I received an iPhone 7 red 128gb which I purchased from https://smarter-phone.co/uk/
The item I purchased was listed as in "premium condition" which states that this item has no signs of use or wear, no scratches, dents, knocks etc… I went with Premium condition as this was a gift.
Upon opening the item I noticed scratches across the length of the screen, a small doesn't on the rear along with a faded circle patch. Refer to images.
I've left 4 messages and sent 2 emails and have not yet received a response.
Their returns policies are shocking as they only allow 14 days from the date of purchase to return the item, even though it takes over a week to be delivered!
I've now seen hundreds of negative reviews on this company, all stating that the items are always wrong, not to the quality as advertised, lack of customer support, etc…
I'd like to get some info on how to potentially sue them for my money back if all other methods of resolution fail.
Any help would be appreciated! 
I have to be clearly missing something here… A a week ago I bought an individual song on iTunes (500 Miles - The Proclaimers), but now I don't see the option to buy when click on the price of other songs. Am I missing a step or something I forgot? I'm logged into my account and everything from the app on my PC laptops… Any thoughts? I haven't used iTunes in a long while and I just recently updated my iPod touch and I want to update my library by deleting some stuff which is easy, but I also don't want to add songs. Buy option not showing? It picks the "software" section on here to post that question, not sure if that's the right one but we shall see. ANY help is greatly appreciated thanks!

I took a trip away from home to stay with my other parent, and thanks to a big mix up here and there on different days with the phone chargers, I switched around my phone charger and charger brands too much and now my phone dies really quickly and takes forever to charge. Is there any way I can fix this?

I'm looking for a tune entitled "Queen of The Senior Prom by Vaughn Monroe which was on the hit parade in 1965. I do not want the Mills Brothers version.
I've searched everywhere, but come up empty. I can't even find it in itunes.
Do you have any suggestions. If I could get a copy of this tune by Monroe, I'd be very grateful. My Dad always asked me to dance with him to this tune.
