Can I sell my iPhone 4 with all my apps still on it?

Ok, so I want to sell my iPhone but I want to know if its (1) legal and (2) practical to sell it with all my downloaded apps on it, some apps being free while others I payed for.

Let me explain a bit.

(1) I know its legal to download apps from someone else's account onto your device, Trust me, I called Apple and checked, so that isn't my question. But I don't know its ok if I'm selling a phone and advertising my apps with it, which I'm just going to download again once I get the newest iPhone.

(2) These same apps (downloaded from someone elses account) seem to stop working when I sync my phone with iTunes (despite the fact Apple explicitly told me it's legal). I'm wondering if this is just due to a setting I have or will this happen to whoever I sell it to which basically means I'm ripping them off by claiming the phone comes with apps as they would stop working upon syncing, which I'm asking this question specifically to avoid.

Why is my iPhone 4s running out of battery so fast?

Obviously iPhones are renowned for low battery lives. But mine is normally fine, i turn my apps off, brightness is never usually high. Though starting yesterday it has been dropping ridiculously quickly, going from 100% at 9am and then within the hour it's gone to less then 30%, my battery isn't lasting longer then two hours before dying, previously it had lasted as long as 8 hours and is heating up alot, can anyone help me out?

Why do I get this numbing tingle every time I touch an electronic?

Every time I touch an electronic device (My PC, iPad, iPod, phone, iPhone, iMac, laptops, my tv, etc) I get this weird tingling feeling when I move my hand on it. Almost like a vibration combined with a bit of a numbness. That feeling is moderate, and fades into the rest of my hand. Though where I'm touching with it, it is very noticeable. It also only happens when my feet are on the ground.

Well that was over a year ago, now a month ago I put my hand on someone's shoulder and felt the same feeling on my hand again. Something not electronic felt electric. That and it happened again when someone was touching a computer and I touched them.

Now today I was making a peanut butter sandwich and went to go get a butter knife, when I got it the metal butter knife constantly felt like it was vibrating. Something that's just metal, not living or electronic.

I received surgery on my arm 2 years ago when I was hit by a car, I got a metal plate and 8 pins which still remain in my arm. Despite my humerus being shattered, it was fully healed in a month to a month and a half. That and I recovered from my severe blood loss and concussion fully of course as well. My doctor said plates and pins shouldn't be the case though. Someone else suggested it could be that I conduct electricity very well though I feel this is too intense to just be conducting.

So why am I feeling this? What causes it? Is it good or bad? What is it all together?

Can I be prosecuted for stealing even if there's no proof?

Recently I was at a party with a roommate and a kid lost his iPhone. The next day they traced it using GPS back to our apartment building. He is convinced we took it but I have no idea where this kids phone is. He told us if we don't return it to him he will prosecute. We have already dealt with the cops and had them search our house and nothing. No clue where this kids phone is but I don't have time or money to get prosecuted. Can he do this?
