Police have my Iphone and I want it back, are they even allowed to take it?

Canada and have recently been in a fatal car accident and lost my friend. While I was unconscious in the hospital the police took both mine, and my friends Iphone's right out of our pockets. Mine contains a video of the crash happening and my friends phone contains texts about the speed we were going.

A week before the crash i got that phone for my Birthday and I really miss it, now the police have it and they said they could have it for about a year. So i'm paying for a service i'm not receiving. So i guess my question is there anyway I can get my phone back!

Yes and sorry guy but sound like you're in deep *** now if all that's on the phones you guys should never had record or text anything about it till after the fact of everything being taken care of. They take it to see if you were ttexting and driving or you can go to your police station and request it back as a demand and see how far you get sorry that happened hope for the best man.

To answer your question, no, there isn't really anything you can do about it. Cut off your service if you like but the police, at least in the US, are allowed to keep personal affects if they are considered evidence in an unresolved case. In this case, an unprocessed one. You can ask for it back but I wouldn't count on getting it back for at least a month or so.
