Sold auto parts on Craigslist now he wants to sue?
Here's the situation…
I sold a pair of used tires ($230/pair Sports Tires that goes for $500 each), the guy met me at a public area. He checked the tires condition. He found a chip on the sidewall of the tire. (I honestly did not know) He said he still wants to buy it but offered a lower price, despite the damage. So he offered ($100) lower than what I was thinking. I told him, I don't have to sell you the tires I'm going home with them. He said, "no, I want the tires" so he offered again ($130). I took the offer… Sold the tires with him aware of the damage.
We didn't sign any paper agreement only verbal.
He is 1 hour away…
Next week he texted me saying he wants to return one tire because he felt that I betrayed him and basically saying I was dishonest with my item.
I told him he made that decision when he bought the tires… He knew the damage and still proceed with the purchase. It's no longer my responsibility.
His idea: He wants me to send him a money order of at least half of the tires cost. ($60) So that leaves me with half the money less and he won't return the tire because he drives a Corvette and will waste gas to go here and give the tire back.
Or else he will sue me for big money. Garnish my income, blah blah… Claiming he knows a lawyer and all the big talk.
He doesn't have my name or address… Just a phone number from an iPhone App Free… Not my cell phone.
How do I respond to this?
Can he sue me for that in the small claim?
